We accept
Visa, Mastercard, Discover and American Express. Sorry, we do not ship
internationally or to Hawaii, Puerto Rico or Alaska at this time.
Restocking and Return Policy
Due
to our commitment to process orders quickly, once the checkout process
is completed our warehouse is immediately notified to pick, package and
dispatch. A 15% restocking fee must therefore be assessed for orders
cancelled once the checkout process has been completed. Customer must
bear all shipping costs on returns and retain proof of shipment until
item is received by us. Customer must obtain authorization from Prime
Pool Market, Inc. before returning any product. Unauthorized returns
will be refused. Returns and exchanges must be made within 30 days of
purchase and include all literature, warranty cards etc. Customer's
account will be credited the full amount of the returned item--less any
applicable charges--only if the item is in original packaging, unworn
and unused. Refunds and credits may take up to two weeks to be
processed and mailed or posted to customer's account. All returns
should be sent by UPS or FedEx and not by US Post. Prime Pool Market,
Inc. is not responsible for returns that are lost or damaged in
shipment and suggests that customers insure their returns. Clearance,
sale and special order items may only be returned if defective and only
for replacement, not refund. All sales are final (no returns) on the
following items: Pool chemicals, alarms, heaters and pool liners (if
opened or unfolded.) Manufacturer warranties still apply.
Credit Card Verification
In
order to protect from fraudulent transactions, the billing and shipping
address is verified through the customer's credit card company. If the
billing address on the customer's Prime Pool Market, Inc. order differs
from the billing address on the customer's bank records the order will
be declined and will not be processed until resolved. Customer is
responsible for verifying that information is correct and for notifying
his/her credit card company to ensure the most up to date information.
Prices and Availability
Some
of our products (especially "close-outs" and "for sale" items) sell
quickly and may no longer be available. Although our site is updated
daily, there may be a delay in reflecting the quantities of product on
hand, especially during the peak summer months. Avoid missing out on
our sale items by acting quickly! Prime Pool Market, Inc. carries a
full inventory of the products we feature but in rare cases may
discover that the product is not available for shipping (eg., it is
damaged or defective), in which case we will quickly notify customer by
e-mail or phone of our intention to fulfill or cancel the order.
Customer will also have the option to cancel the order. All prices,
products and offers are limited to stock on hand and subject to change
at any time without notice. Current prices are not applicable to
previous or future purchases. No rain checks unless specifically
stated.
Shipping and Handling
All
orders are shipped by UPS ground. Most orders are shipped within 24
hours and the customer can expect to receive the order within 2-5
business days depending on location. Seasonal items may also take
longer due to high demand. Refusal to accept a delivery, for whatever
reason, will result in a charge to the customer's account for both
arrival and return costs (plus any storage charges), pending
resolution. The customer or a designated person (eg. neighbor) is
responsible for signing for items as necessary.
Warranties
We
do not handle warranty claims directly but pledge to assist our
customers in any way we can. All our products are guaranteed to be
brand new unless stated and carry a full manufacturer's warranty. If a
customer feels he/she has received a defective product, please contact
the manufacturer direct prior to contacting Prime Pool Market, Inc..
Terms and duration of warranties vary and different manufacturers have
different definitions of "worn out," "defective" and "reasonable wear
and tear." For more details on warranty terms and conditions, please
read the warranty card packed with your purchased item. For a list of

Our Rights and Disclaimer
We
reserve the right to decline a sale to anybody for any reason.
Possession of printed material from our website does not constitute a
binding agreement. Products, pricing, and specifications are subject to
change without notice. Product substitutions of equal or greater value
may be necessary due to out of stock conditions. Prime Pool Market,
Inc. is not responsible for typographical errors in descriptions and
pricing, and the pictures on our web site should be seen only as
representations and may not always be an exact match of the product(s)
we ship. Prime Pool Market, Inc. disclaims any liability for injury or
damage of any kind arising from the installation, use or inability to
use any product we sell. It is the customer's responsibility to know
that some products are required to be installed by a licensed
contractor.
Governing Rules
Transactions
between the customer and Prime Pool Market, Inc. shall be governed in
accordance with the laws of the State of Florida, without regard to
conflicts of law. By using our web site the customer hereby agree that
any litigation regarding this agreement or any transaction between the
customer and Prime Pool Market, Inc. shall be brought in the state or
federal courts located in Palm Beach County Florida, and that the
customer shall hereby -- without signature real or electronic -- submit
to such jurisdiction and venue.
